    1. Qualifying Products

        1.1. Grasim Industries Limited, Birla Paints Division (“Company”) is offering a one-year comprehensive assurance (“Birla Opus Assurance”) on all Birla Opus products, except excluded products mentioned in the Schedule, as may be modified by the Company from time to time (‘Products’).

    2. Applicability

        2.1. For the Birla Opus Assurance to be applicable, the following conditions need to be met:

    (a) The painting job needs to be executed by a Birla Opus certified contractor.

    (b) Minimum paintable area has to be 2000 sq. ft per house/painting site;

    (c) The entire paint system (including undercoats) needs to be applied in accordance with the guidelines specified in the latest PIS of the Products used.

        2.2. Birla Opus Assurance shall apply to the overall paint system (including undercoats).

    3. Registration and Commencement

        3.1. Birla Opus Assurance shall be effective only on successful registration and painting project closure by a Birla Opus certified contractor. The site needs to be registered within 30 days of the date of first purchase of the Products and the painting project closure must be within 120 days from date of registration, for Birla Opus Assurance to be applicable.

        3.2. Birla Opus Assurance shall commence from the date of completion of painting work as reflected on the Opus ID application (“Commencement Date”) and shall be valid for a period of one year (“Term”).

        3.3. Upon settlement of any claim, Birla Opus Assurance will not start afresh, and will continue for the remainder of the Term from the Commencement Date.

        3.4. Birla Opus Assurance is made available only for Products used in respect of the actual area painted and shall mandatorily be scanned & reflected in Opus ID application for availing the assurance.

        3.5. Registering for Birla Opus Assurance in the following conditions is subject to a satisfactory pre‐inspection at site by Company’s representative:

    (a) For Interior or Exterior painting, where the paintable area is equal to or more than 25,000 sq.ft.; or

    (b) For waterproofing, where the paintable area is equal to or more than 3,000 sq.ft; or

    (c) Any other case where the Company may want to examine and confirm the application of the Products

    4. Parameters

**Definitions of Parameters

 

Flaking- Flaking covers instances where one coat of paint film loses adhesion to the subsequent coat of paint film and starts to come off in flakes/chips for a minimum continuous area of 1.85 sq.m (20 sq.ft) over a painted surface due to cracking of paint film without application of any external man-made force.
 

Peeling- Peeling covers instances where at least 1.85 sq.m (20 sq.ft) of continuous paint layer detaches from the substrate or undercoat (detached paint layer looking like a blanket) without application of any external force.
 

Blistering- Blistering covers appearance of bubbles (blisters) over the painted surface resulting due localized loss of adhesion and lifting of the paint film from the underlying surface, observed on a minimum continuous area of at least 1.85 sq.m (20 sq.ft).
 

Dampness- Dampness covers instances of water ingress from the coated substrate due to external water sources with visible dampness/leakage/seepage on the inside walls/ceiling on a minimum continuous affected area of 1.85 sq.m (20 sq.ft).
 

Patchiness- Patchiness covers instances of uneven or irregular film appearance due to difference in color or sheen in localised patches on a painted surface when the surface is painted with same lot of paint in one go and exposed to equal intensity of light, observed on a minimum continuous area of at least 1.85 sq.m (20 sq. ft).
 

Algal growth- Algal growth covers instances where heavy algae growth is seen on surface painted with exterior emulsions or enamels for at least continuous area of 1.85 sq.m (20 sq.ft) which is not cleanable by pressure water wash in dry season.
 

Fungal growth- Fungal growth covers instances where heavy fungal growth is seen on surface painted with interior emulsions or enamels for at least continuous area of 1.85 sq.m (20 sq.ft).
 

Chalking- Chalking covers instances where loose paint gets heavily deposited on bare hand while rubbing a dried and cured paint film observed over a minimum continuous area of 1.85 sq.m (20 sq.ft), provided hand rub is without putting extra pressure. Any other deposits on the paint surface such as dust, dirt, salt etc. are not considered as chalking.

    5. Replacement Costs 

        5.1. On observation of any issue covered under Birla Opus Assurance, the Company shall bear the Replacements Costs to repair/ repaint the affected areas. “Replacement Costs” in this paragraph mean the cost of material including undercoats and labour required to correct the affected portion, as determined by the Company.

    6. Claim Procedure

        6.1. Consumer may raise a claim within 30 days of discovering any issue(s) in the painted area based on Parameters as detailed in Para 4.

        6.2. The Consumer is required to notify the Company of the issue(s) noticed by contacting the customer care at 1800 120 1234 or email us at opuscare@adityabirla.com. The Consumer shall provide such additional details as required by the Company and/or allow the Company to visit/inspect the painting site either in portion or entirety at the Company’s discretion.

        6.3. In case the Consumer carries out repair works on the areas covered under Birla Opus Assurance, the same shall be at their own risk and Birla Opus Assurance shall not be valid on such repaired areas.

    7. Exclusions

        7.1. Birla Opus Assurance will not cover any issue arising due to factors beyond Company’s control, including but not limited to:

        a. Act of God, vandalism or any form of violence

        b. Active leakage not arrested at the time of painting/ or waterproofing products not applied by Consumer for moisture observed by a Birla Opus certified contractor

        c. Any alteration, modification or extension of the painted area/site whether of civil or structural nature 

        d. Structural cracks, movements or shifting

        e. Mechanical damage or puncturing of the paint film

        f. Impact of exposure to any harsh chemicals or corrosive substances such as solvents

        g. Fire or accident

        h. Normal wear and tear

        i. Improper housekeeping such as hanging of wet cloth on painted wall, dragging of furniture along painted surfaces, waterlogging on terrace, failure to regularly clean of dust, oil, or external particles etc 

        j. Writing or doodling on the walls, spitting, bird droppings, damage caused by animals, insects, efflorescence, lime blooming etc

        k. Any issue arising due to a tree or plant being in contact with a painted surface, painted surface being beneath a tree, or staining due to planted pots

        l. Defect caused due to wear and tear upon exposure or caused due to extreme environmental conditions or defects in surface itself. 

        m. Any act of commission or omission on the part of the Consumer not in line with the PIS 

        n. Any other causes other than defect in the Product. 

    8. Limitations of Liability & Dispute Resolution 

        8.1. Except expressly stated, the Company disclaims any liabilities whether in contract, tort or otherwise and does not make any implied warranties pertaining to the Products. 

        8.2. The Company shall not be held liable towards loss or damages of incidental, indirect or consequential nature. 

        8.3. In case of any disputes, exclusive jurisdiction of the courts of Mumbai shall apply. Governing laws shall be Laws of India.

        8.4. The facts and all matters concerning any claim/ dispute will always be kept confidential by both the Consumer and the Company.

If Birla Opus Assurance does not apply to your painting project for any reason stated in this document, you may register for the applicable product warranty, governed by its respective terms.

If you opt for Birla Opus Assurance, your Birla Opus certified contractor will also register for the relevant product warranty, subject to its respective terms and conditions.

We can (and you authorise us to) disclose any personally identifiable information about you to law enforcement and other government officials as we, in our sole discretion, believe reasonably necessary or appropriate, in connection with any investigation.

4.2. Changing Your Personally Identifiable Information

 

In case you request to remove your personally identifiable information from our records, we will retain such information in our files and databases, in order to use it in some unavoidable circumstances, such as to resolve disputes, troubleshoot problems, and enforce our terms and conditions. Further, such prior personally identifiable information is never completely removed from our databases due to technical and legal constraints, including stored "back up" systems. Therefore, you should not expect that all of your personally identifiable information will be completely removed from our databases in response to your requests. 

5. USER OF COOKIES

However, you agree and acknowledge that "perfect security" does not exist on the Internet.

Product Warranty

Terms and Conditions for product warranty registration of Birla Opus products



  1. The Warranty shall be effective from the date of purchase of the Product as per the tax invoice (“Warranty Start Date”), provided that painting work is fully complete, and the Consumer registers the Product for warranty.

  2. The Product must be registered within 15 days from the date of purchase by calling customer care at 18001201234 or registering on www.birlaopus.com and furnishing purchase details as required during the Warranty registration.

  3. The Warranty shall be valid for parameters and period as defined in the respective product warranty document (‘Warranty Period’) from the Warranty Start Date. 

  4. Upon settlement of any claim, Warranty of replaced Product will not start afresh, and will continue for the remainder of the Warranty Period from the Warranty Start Date.

  5. If there is a break/ lag in completing the painting work, the registration of the Warranty and Warranty Start Date will be determined by the Company at its sole discretion.

  6. The Company may appoint a person to examine and confirm the application of the Product as per the directions specified prior to registering the Warranty.

  7. For registering of Warranty, where quantity of Product purchase is equal to or more than 200 litres, please call our Helpline on 1800 120 1234 with requisite details. The registration of Warranty in such cases is subject to a satisfactory pre‐inspection at site by Company’s representative.

  8. For the warranty to be applicable:
    1. Minimum volume of the product required to be purchased needs to be met
    2. Birla Opus recommended system needs to be used
    3. Product coverage and application guidelines need to be adhered
       

For more details, please refer to respective  product specific warranty document and product information sheet.

  1. Consumer may raise a claim within 30 days of discovering issue(s) noticed on the affected areas based on Warranty Parameters/ scope

  2. The Consumer is required to notify the Company of the issue(s) noticed along with the invoice details, sample pictures and basis for Warranty invocation by contacting the customer care at 1800 120 1234. The Consumer shall provide such additional details as required by the Company and/or allow the Company to visit/inspect the painting site either in portion or entirety at the Company’s discretion.  

  3. In case where the Company decides that the Warranty is applicable on the issue(s) noticed on the affected areas, the Company shall bear the Replacements Costs as detailed in respective product warranty document to repair/ repaint the affected areas.

  4. Replacement Costs shall mean the cost of material and labour required to correct the affected portions, as determined by the Company.

  5. In case where the Company decides that Warranty is not applicable, the same shall be communicated to the Consumer.

  6. Warranty is applicable only to the affected area where the Product is used in accordance with application guidelines and not to the rest of the areas.

  7. In case the Consumer carries out repair works on the areas covered under the Warranty, the same shall be at their own risk and the Company’s Warranty on the Product shall not be valid on such repaired areas.

  8. The Warranty will cover only manufacturing defects of the Product and will not cover any defects arising out of factors not in control of the Company. For more details of exclusions, please refer to the warranty document of respective product. 

  9. Except expressly stated, the Company disclaims any liabilities whether in contract, tort or otherwise. The Company makes no warranty regarding merchantability or fitness of products for any particular purpose. 

  10. The Company shall not be held liable towards loss or damages of incidental, indirect or consequential nature or for any value more than the tax invoice value. 

  11. In case of any disputes, exclusive jurisdiction of the courts of Mumbai shall apply. Governing laws shall be Laws of India.

  12. The facts and all matters concerning any Warranty/ claim/ dispute will always be kept confidential by both the Consumer and the Company.
